Aus gegebenen Anlass. Russland will die ADR´s aufkündigen. Was sagt die Comdirect dazu? Welche Möglichkeiten hat der Anleger?

angenommen bei Max Blue werde die ADRs noch getauscht.. dann bekommt man die Originalaktien geliefert, wenn alles glatt läuft … ist das dann ein Typ-C Depot? Wo ist der Vorteil, wenn man bei der Gazprombank ein Depot eröffnet? Mal ausgenommen, dass es ein russisches Institut ist

Mir ist es lieber, dass meine Aktien im Depot bei einer deutschen Bank verwahrt werden, als in einem Depot bei einer vom russischen Staat maßgeblich beeinflussten Bank. Insbesondere habe ich die Hoffnung, dass die Anschaffungsdaten bei der Verwahrung bei einer Deutschen Bank nicht verloren gehen. Der Übertrag von konvertierten Aktien zur Gazprom-Bank ist/war für mich nur  Plan B.  

Typ-C Depot bedeutet nach meinem Verständnis (bitte selbst nachprüfen), dass die Identitätsangaben des Inhabers nur vorläufig aufgrund der von ihm online zugesandten Unterlagen festgestellt wurden. Es ist nach meinem Kenntnisstand zwar möglich, Gazprom-Aktien in ein Typ-C Depot einbuchen zu lassen. Um über die eingebuchten Aktien irgendwann einmal verfügen zu können, ist es jedoch nötig, die Identitätsangaben in eine Filiale der Gazpromban verifizieren zu lassen.

What steps should I take to convert the depository receipts into ordinary shares?

In accordance with the Decision of the Board of Directors of the Bank of Russia dated July 22, 2022, for depository receipts that are stored in Russian depositories, an automatic conversion procedure is provided, which will begin on August 15, 2022. Holders of the depositary receipts will be credited with the corresponding number of ordinary shares at the request of the issuer (Sber).

Holders of Sber depositary receipts stored outside the Russian Federation, or persons in whose interests such holder acts, need to follow three simple stepsto receive ordinary shares as a result of the conversion of Sber depositary receipts.

For holders of the depository receipts, who are non-residents of the Russian Federation, Sber ordinary shares will be transferred to the type-C depo account specified in the conversion request.

The type-C depo account scheme for settlements and transactions is described in detail in the Decision of the Bank of Russia Board of Directors dated 18 March 2022.

In light of the restrictions imposed by foreign regulators and issued licenses, non-residents from foreign states may be limited in their rights to hold Sber shares after the deadlines set by the regulators. Hence, foreign investors have to individually assure that there are no restrictions with respect to Sber securities under the applicable laws, rules or restrictive regulations of the country of their residency.

How can I open a depo account with a Russian depository bank if I am a non-resident of the Russian Federation?

To open a depo account, a foreign holder of depositary receipts must contact their global depository bank that keeps their securities or a broker that has an account with a foreign depository bank and ask them about their policy in respect to holding ordinary shares of Russian issuers.
If foreign providers of depository services do not allow safekeeping and recordkeeping of Russian shares, a depo account can be opened with any Russian broker or depository bank that provides such services to foreign clients.

For all issues related to restrictions imposed by foreign regulators and issued licenses regarding securities and/or Sberbank services, investors need to independently analyze the arising risks.

1. Prepare a free-form application for a forced conversion of depositary receipts into ordinary
shares of Sberbank, indicating the following information:
a. Application date
b. Applicant contact and certifying details
c. Information about depositary receipts

2. The application must be accompanied by all documents available under the circumstances

a. Ownership of a specified quantity of depositary receipts
b. Chain of nominee holders - information about the foreign nominee who records
the rights to depositary receipts, and about allhigher-ranking nominee holders
(foreign nominee holders).

3. The application should be signed and sent along with the documents to the Russian
custodian, CB “J.P. Morgan Bank International” (LLC) by October 12, 2022.

Hey, ich bin ziemlich überfordert mit der situation. Ich habe nur ca 300 ADRs was mal 1300€.  Lohnt sich da der Aufwand mit Gazprom Bank? Kann ich sie dannach dort verkaufen und mir das Geld transferieren lassen? Ist es besser die ADRs einfach liegen zu lassen bei der Comdirect? Ich schätze bei einem Zwangsverkauf kauft die irgendein ein drecks Hedgefond für paar Cents auf.

Ich glaube da braucht es keinen Hedgefund. Es reicht ja, wenn Grossbanken mit ihren Ablegern nicht nur die Aktien aus den von ihnen aufgelegten ADRs verkaufen sondern bei gedrücktem Marktpreis gleichzeitig auf der Käuferseite aktiv werden.

Verbuch es unter Erfahrung zum einen 

mit deutschen Banken und dem deutschen (US / Europäischen) Rechtssystem

und zum anderen mit 

Recht habe bzw. bekommen.

Zur Erläuterung:
Rein rechtlich gehören die Aktien (und damit die Anteile) Dir,

aber obwohl Deutschland und Europa Handel mit den Firmen (Gazprom, Lukoil, Norilsk, etc.) treiben darfst Du Deine Anteile nicht verkaufen!

Sollte mich nicht wundern, wenn dasselbe mit chinesischen Aktien in 2-3 Jahren passiert!

Die grosse Frage ist doch, wer darf zum Zeitpunkt X überhaupt kaufen !?

Wenn z.B. die westl. Banken / Hedgefonds wegen westl. oder russ. Sanktionen vom Kauf ausgeschlossen sind, wer bleibt dann noch ?

Hallo, 

ich verfolge hier schon seid 1 Monat diesen Forum und bin soweit das ich jetzt bei Maxblue ein Konto eröffne! 

Ist es möglich überhaupt ein Depo zur übertragen? 

Comdirect hat mir heute ein Brief geschrieben das  ich die ADRS bis zum 8 August übertragen kann. Da die frist jetzt verlängert wurde.

kann mir vllt jemand erzählen was dann genau ich zu tun habe wenn das Depo offen ist`X(tut mir leid für die blöde frage )
